Chiniewicz trial to begin Monday

Susan Chiniewicz, wife, mother, and business owner from The Colony, is set to be tried Monday for capital murder in a Brazos County court, after allegedly leaving her newborn to die in a trash can at a race track in Brazos County.


Chiniewicz was arrested in April in connection to the October 2005 death of a newborn, dubbed "Baby Joseph" by Brazos County authorities. The infant's body was found by a crew member at the Texas World Speedway, according to a probable cause affidavit, while he emptied a trash can in a women's restroom. Brazos County sheriff's deputies located the infant's body inside a black plastic trash liner, the affidavit stated, in a container with paper, beer bottles, and other trash. Blood stains were found in a stall and a small container.

A forensic pathologist at the Southwest Texas Forensic Laboratory in Conroe, Texas, determined the child was born alive at full-term, according to the affidavit. She ruled the death a homicide caused by suffocation with environmental exposure and neglect.

What was believed to be a piece of trash was found in the baby's breathing passage, the affidavit said.

The body was found after a weekend motorcycle event that attracted at least 1,200 attendees, according to documents. A mailing to attendees led to contact with Chiniewicz, according to a previous Brazos County statement. She told police she might have made a mess in the bathroom after a "heavier than normal" menstrual cycle, according to the affidavit.

Chiniewicz told an investigator that a doctor could verify she had not been pregnant, the affidavit said. A doctor later told an investigator that he could not rule out a pregnancy.

Chiniewicz arranged in late October to provide a DNA sample to investigators, according to the affidavit.

After being presented with DNA results in April, Chiniewicz told authorities she was the baby's mother, the affidavit stated. She told investigators that she gave birth in the stall, cleaned herself and the baby, and placed the baby in a trash can.

According to an article published on the Bryan-College Station Eagle Web site, Chiniewicz was one witness testifying at an April court hearing following her arrest. The article states that Chiniewicz testified that the baby was already dead when she delivered it.

Jim James, Chiniewicz’s attorney declined to comment.

Brazos County District Attorney Bill Turner said he does not expect charges against anyone else involved in the case.

"This was the only suspect in the case, and we do not anticipate any others," Turner said.

The case took about nine months to move from arrest to indictment. Turner said in every case his attorneys must make sure the evidence meets the standard needed for a conviction before proceeding.

"In our office, we try to make it courtroom-ready," he said.

Chiniewicz was released on bond about one month following her arrest.

" Come on Mike do you see nothing wrong with her putting her baby in the trash and she admitted to that she also admitted that she rejoined her husband after dumping the baby and acted as though nothing happened.... how cold is that. Even if the baby was dead as she claims what kinda of person does that and then goes about her business. "

Why would you bring your other children to something like this? Very little justice has been done for "Baby Joseph". She kept saying that lives would be ruined........she seems to have forgotten one small life that is no longer here. "
