Repeat DWI offender sentenced to 40 years: Man flees police custody, currently considered a fugitive

Law enforcement officers are currently searching for a Plano man who fled from custody shortly before being sentenced to jail for driving while intoxicated.
Richard Davis Callaway, 48, was sentenced to 40 years in prison on Wednesday following his sixth conviction for driving while intoxicated. However, Calloway didn't return to the courtroom after a recess for lunch prior to closing arguments and is now considered a fugitive and a warrant has been issued for his arrest.
On February 21, 2010, Callaway was pulled over by a Plano police officer for running a red light at Preston Road and Spring Creek Parkway. When the officer approached the vehicle, he noticed Callaway smelled of alcohol and had slurred speech. During the course of the roadside investigation, Callaway failed all three standardized field sobriety tests. He also admitted to the officer that he had been drinking and asked if he "could just walk home." Callaway was arrested, but refused to give consent for a blood test.
Testimony presented during sentencing showed that Callaway had been to prison at least twice before on burglary charges and prior DWI charges. In 1992, Callaway was convicted of his third DWI in Denton County and was sentenced to 15 years in prison. After considering all of the testimony and the prior convictions, Collin County Judge Ray Wheless sentenced Callaway to 40 years in prison.
